E-bikes are becoming a go-to choice for many people, thanks to their convenience and speed. But not every ride goes as planned. Defective e-bikes—a faulty brake, a battery that overheats, or a frame that gives out—can lead to serious injuries. The reality is that some manufacturers cut corners to save money, and that can put riders at risk. If you’ve been injured due to a defective e-bike, you may be eligible to file an e-bike lawsuit under product liability laws. These claims hold manufacturers and other responsible parties accountable for dangerous designs, substandard materials, or improper assembly. Partnering with an e-bike accident lawyer from Ethen Ostroff Law can help you recover compensation for your damages.

What Is an Electric Bike?

E-Bike Lawsuit

An e-bike, short for electric bike, is similar to a standard bicycle but with an extra boost. It’s powered by a rechargeable battery and an electric motor, allowing you to ride faster and climb hills without breaking a sweat. Some e-bikes require pedaling to activate the motor, but others let you cruise with the push of a button. Depending on the model, you’ll need to recharge the battery after riding somewhere between 20 and 100 miles.

E-bike Accident

Practical and exciting, E-bikes are surging in popularity. However, E-bikes pose a greater injury risk than traditional bikes. Clearly, with the huge increase in the use of electric bikes, there are more accidents and related injuries.

E-Bike Accidents in the United States

As e-bikes become more popular in the U.S., the number of accidents involving them has been rising sharply. Here’s a look at some key facts about e-bike accidents:

  • Injuries jumped from 751 in 2017 to 23,493 in 2022.
  • Hospitalizations rose from 66 in 2017 to 3,122 in 2022.
  • Over 45,000 emergency room visits were linked to e-bike injuries from 2017 to 2022.
  • At least 53 fatalities were reported between 2017 and 2022, with deaths rising from 6 in 2018 to 42 in 2022.
  • Older riders are more common and often wear helmets less than traditional cyclists. Many are also intoxicated when injured.
  • Children aged 10-13 are especially vulnerable, with many not wearing helmets.

Common Causes of E-Bike Accidents

E-bike accidents can happen for many reasons, some similar to traditional bicycles and others unique to the speed and mechanics of e-bikes. Common causes include:

  • Defective components: like faulty brakes, battery malfunctions, or weak frames, leading to mechanical failures
  • Neglecting maintenance: leading to brake failures or tire blowouts
  • Accidents involving motor vehicles: often due to low visibility or failure to share the road safely
  • Riders transitioning from regular bikes to e-bikes without proper training: leading to a lack of understanding of the e-bike’s handling
  • Difficulty controlling the e-bike at higher speeds: especially in unfamiliar areas
  • Misjudging speed and control: leading to dangerous situations
  • Distractions: like smartphones, preventing timely reactions to hazards
  • Aggressive riding: like weaving through traffic or ignoring traffic signals
  • Potholes, uneven surfaces, and poor bike lanes: causing loss of control
  • Poor weather or lighting conditions: reducing visibility for riders and drivers

Understanding these causes is key to improving safety and reducing accidents.

Common E-Bike Accident Injuries

E-bike accidents can lead to different types of injuries, and they’re often more serious because e-bikes go faster and involve more risk of collisions. Some of the most common injuries include:

  • Broken bones: especially in the arms, legs, wrists, and ribs, often from falls or crashes
  • Cuts, scrapes, and road rash: from contact with rough surfaces
  • Concussions: often from falls or vehicle collisions, especially when helmets aren’t worn
  • Back and neck injuries: which can lead to long-term disabilities
  • Internal bleeding or organ damage: from impact, often life-threatening
  • Bruising and contusions: from impacts during accidents
  • Dental trauma and fractures to the face: from falls or collisions

Tips to Prevent E-Bike Accidents and Injuries

To prevent e-bike accidents and injuries, riders should take a proactive approach that combines safety gear, good riding habits, and regular bike maintenance. Here are some key tips:

  • Wear a properly fitted helmet with extra protection like MIPS to reduce head injury risk.
  • Follow traffic laws, including stopping at signs, signaling, and riding with traffic.
  • Inspect your e-bike before each ride—check tires, brakes, and wheels.
  • Control your speed and brake early to account for longer stopping distances.
  • Wear proper clothing and secure footwear to avoid accidents.
  • Stay focused—avoid distractions like headphones or mobile devices.
  • Plan your route, using bike lanes and avoiding high-traffic areas.
  • Be aware and practice defensive riding, using signals and reacting to hazards.
  • Never ride under the influence of alcohol or drugs.
  • Take a safety course to improve riding skills and build confidence.

By following these tips, you can significantly reduce the risk of accidents and injuries.

Product Liability in E-Bike Accidents

E-bike accidents can sometimes be linked to defects in the bike itself or its parts. Here are some key points:

  • defective design can make an e-bike unsafe. For example, if the bike’s brakes don’t work well or it’s unstable, the design could be defective, leading to accidents.
  • Even if the design is good, mistakes in how the bike is made can cause problems. Manufacturing defects like poor assembly or cheap parts can make the bike dangerous.
  • Manufacturers must also warn riders about any risks. If a bike doesn’t have the right warnings or instructions, and someone gets hurt, the maker could be responsible for failure to warn.

These issues help determine if a defect played a role in an accident.

Most Common Defects in E-Bikes that Lead to Liability

Common defects in e-bikes that can lead to accidents often involve mechanical and electrical problems. Here are the key issues:

  • Faulty batteries: can overheat or explode due to manufacturing defects or mishandling.
  • Malfunctioning brakes: can fail, leading to loss of control, due to worn pads or misalignment.
  • Defective motors: may fail, causing sudden power loss and difficulty controlling the bike.
  • Weak frames or forks: can collapse under stress, causing accidents.
  • Tire blowouts or locked wheels: can result from defective parts or poor maintenance.
  • Control system failures: like wiring issues or glitches, can cause erratic bike behavior.
  • Defective tires: can lead to punctures or blowouts due to improper inflation or poor materials.

Regular maintenance and prompt attention to any issues can help prevent these risks and ensure safer riding.

Potentially Liable Parties in E-Bike Accidents

Regarding e-bike accidents, product liability laws help determine who may be responsible for injuries caused by defects or unsafe conditions. Several parties can be held accountable under these laws:

  • Manufacturers: can be held responsible if defects in design, manufacturing, or assembly cause accidents.
  • Retailers: may share liability if they sell unsafe e-bikes or fail to warn consumers about potential risks.
  • Rental companies: are liable if they provide defective e-bikes or fail to maintain them properly.
  • Component manufacturers: can be held responsible if defects in parts like motors or batteries cause accidents.
  • Repair shops: may be liable for accidents caused by poor repairs or maintenance.

Proving Product Liability in an E-Bike Lawsuit

To win a product liability claim in an e-bike accident, the plaintiff must prove four things:

  • The defendant designed, manufactured, sold, or distributed a defective e-bike.
  • The defect was present in the e-bike when it left the defendant’s possession.
  • The plaintiff used the e-bike in a reasonably foreseeable manner.
  • The plaintiff suffered harm because of the defect in the e-bike.

A product defect is any flaw that affects how the e-bike operates or its safety. Harm can occur when users aren’t properly warned about risks, haven’t been given proper instructions, or continue using a recalled product without knowing it’s defective.

Things to Do After an E-Bike Accident Due to a Defect

If you’re in an e-bike accident caused by a defect, take the right steps immediately. Here’s what to do:

  • Check for injuries, and call 911, even if the other party tries to convince you otherwise.
  • Snap photos of the scene, your bike, any injuries, and the vehicle involved, including its license plate and any damage.
  • Get medical attention as soon as possible, even if you don’t feel seriously hurt. It’s important to be evaluated.
  • Make sure to gather the other person’s insurance, contact information, and driver’s license number.
  • Reach out to an e-bike accident lawyer. They can guide you through the legal process and investigate whether product liability is a factor.

Taking these steps helps protect your rights and ensures you’re properly covered if a defect caused the accident.

Process for Filing an E-Bike Accident Lawsuit Due to Product Liability

Filing an e-bike accident lawsuit based on product liability can be a detailed process, but it’s essential for holding the responsible parties accountable for defective products. Here’s an overview of the steps involved in pursuing a product liability claim after an e-bike accident:

  • Get medical help immediately to document your injuries, even if they seem minor.
  • Reach out to an experienced e-bike accident lawyer to evaluate your case and guide you through the process.
  • Work with experts to identify the defect in the e-bike that caused the accident.
  • Identify who’s at fault, including the manufacturer, retailer, or rental company.
  • Collect medical records, photos, witness statements, and any product-related documentation.
  • Your e-bike accident lawyer will file the e-bike lawsuit, outlining how the defect caused the accident and the damages you’re seeking.
  • Your e-bike injury lawyer will negotiate with the defendant’s insurance to secure a fair settlement.
  • If no settlement is reached, your e-bike accident lawyer will take your e-bike injury lawsuit to court to seek compensation.

Damages in E-Bike Accident Cases

If you’ve been injured in an e-bike accident caused by a defect, you could be entitled to compensation for:

  • Lost income due to time off work
  • Reduced earning ability from long-term injury
  • Pain and suffering from the accident and recovery
  • Medical expenses for treatment, rehab, and care
  • Repair or replacement costs for your e-bike and personal property
  • Funeral costs, lost support, and other damages in case of a wrongful death

Each e-bike accident has its own unique damages, and the financial impact varies based on the specific situation.
